Tier 5 expired, can I visit before getting my Tier 2?

Hi there, bit of an odd/different question here.

I'm a Canadian and I worked in England for two year on a Tier 5 Youth Mobility Visa which expired on August 15th 2015. I left the UK on July 24th as my employer was quite confident that they would be able to sponsor me in August or September with a Tier 2 General visa.

Now, my employer has been declined for a certificate of sponsorship every month since May, as my salary is 24,800ish. I have a boyfriend, a lease on a flat (yeah, not good!!), a bank account, a car, friends, and most of my stuff left in the UK.

I want to visit for 2-3 weeks, return to Canada and wait for my visa possibility. My employer is still trying to get a certificate of sponsorship for me for October-December. I will have with me my return flight, a letter stating that I have a part-time job in Canada, a letter ordering my new Ontario health card, and information for where I'm staying the whole time. Are my remaining goods and lease, etc. in the UK going to seem suspicious for the border agency? I'm not going to England to cancel any of that because I do wish to get back in November/December on my Tier 2, but I'm wondering whether it's worth it to even try to visit.

Have you stayed with your boyfriend for the two years that you were here?

Unfortunately not :(

He lived in Surrey, I was in Buckinghamshire so he lived with me on weekends. I'm applying for my Tier 2 sponsorship and we planned to live together two years on that, but obviously our plan has not gone perfectly because of excess applications to Tier 2 general who are not poorly paid teachers :(

Interested on what happened to you when you went back in? I am in the exact same situation as you, and have been waiting to see if sponsorship will work out. Soon, if it does not then I am giving up but all of my stuff is in my flat with my boyfriend (not british), and I would really like my stuff especially my winter clothing. Did you have any issues?

I thought nobody would be interested in this thread on a personal level! I flew back on September 23rd. We were the firs flight in from Toronto to London that day, I got a female border control officer. She grilled me hard, but was fine with all my answers, but I also brought a lot of paperwork proof just in case. She asked to see my return flight booking, my travel insurance and proof of work (a letter from my boss) in Canada. I was given clearance for up to one month only, as I spent upto the end of July in the UK from my job. But, after this it's unlikely they will let me back in for a while, as I've spent more time in the UK this year, than in Canada.

So, it worked! I am here to visit until October 14th, hopefully the visas go through this round!!! And if they don't, I'm going I bring all my heavy winter stuff home. Less to ship in the worst of scenarios.

I would love to hear from you, both visit-wise and visa-wise! It's nice to know I'm not going through this alone, and that someone can relate to something that can cause a lot of personal anguish. I know it has for me. Anyways, wishing you all the luck in the world!

Congrats on getting yours approved! I saw on the other thread, it is so good that they came down in points this month.

I completed my application on monday right after I found out and there were appointments next day so I went and submitted my documents and biometrics today so they will be in New York tomorrow Morning! I also paid for priority as I want to go back ASAP! Crossing my fingers.

Thank you for the advice. I am really glad that I hopefully will not have to worry about getting back into the UK as a visitor, it was quite stressful there for a while. Good luck to you!!
