Entrepreneur Team Member Leaving

Hi Guys

Hope you can help with a query regards Tier 1 Entrepreneur extension, my team member and 1 were successfully granted Tier 1 Visa in July 2014, to date we have opened 3 new business's and also created 4 positions for the employment criteria. Unfortunately due to unforeseen circumstances my business partner is having to return back home (deaths in family). I have phoned the Home Office and they say i also have to return back to my home country and re-apply for myself. Obviously it is not that easy to simply close 3 business's and lose the investment that we have made without any guarantee that i will get a new visa for myself.
I have asked for this in writing from the Home Office but they have said they are unable to do this.

Any thoughts? Any help and advice greatly appreciated before i go the expensive lawyer/solicitor route.

can you not dispute it with home office?

it is not your fault he is dropping out is it? he was prepared to go along all the way with you for whatever reasons he changes his mind you should not be getting done for this reason. policy/law does not have anything in relation to this, part of guidance UKVI should provide advice for applicants to have contingency plans and how if one of entrepreneurial team member chooses to make his way

That is my argument also with the home office.. they have promised me a call back with a senior manager within 5 days to get clarification.

Hi Saleem,
I had same issue, my team partner left after 6 months so I called to home office.
They reply me back by email that, it will not effect you until you proof that £200000/- invest by your self and other visa requirement. First they told me on phone but I insist I need by email to show on extentation. So they sent by email.
My opinion call again and speak to manager and ask for by email.
Please share with us what they response. .

Hi Nadeem

Once i get clarification from the senior manager i will post what they say here.
Can you send me a copy of the email you got from the home office so i can argue the point if they tell me something different.
