Tier 2 visa appliation

Hello,

I have a question regarding visa application, switching from tier 4 to tier 2. I have just rang the UKVI today asking if Im able to apply my visa after the expiry date and they say yes as long as its before the 28 days. However, I read thru some of the post saying that it is mot applicable in this case. So which one is the correct one?

obviously what ukvi says is more authentic
