Tier 2 RMLT

Hi,

I’m a non-EEA national who moved to the UK on March 2013 under a CP visa. Since my relationship is not working out, I'm planning to switch to a work related visa.

I have a very stable job in a multinational company and they are planning to sponsor my Tier 2 visa.

As part of the labour test, they are going to advertise my own role but I’m slightly worried about what will happen in case they find a suitable candidate.

I was told that according to the RMLT legislation, if the company finds a suitable candidate who has the right to work in the UK then they will need to offer him the position. However, since I currently have the right to work using my CP visa and I’m in theory the “owner” of the position, would I be able to then pull out of the RLMT and continue employed using my CP visa? Or would I lose my job?
