Naturalisation and CCJ (desperate for an answer)

Post by erhnaks » Tue Sep 22, 2015 10:22 am

Hi dear forum users,

I have a active CCJ from 2012 for a credit card bill £1071. I am going to apply for naturalisation by this month. Will an active CCJ get me refused for an application for naturalisation? Has anyone got approved with a CCJ recently... Please do comments if yourself or someone you know got approved. Please I am desperate to get an answer to this. since yesterday I am searching whole web to get an answer but did not get anything so far. Any help would be gratefull...
Regards.

CCJs are taken into account. Section 3.3 of the AN Form asks for Civil Judgements - which a CCJ is (CCJ = County Court Judgment).

So in Section 3.3 you need to declare the CCJ. I am not sure about the guides the Home Office staff using and how many are acceptable .. But leaving it out is pretty much a refusal (as they WILL check it).

Have a look at the FAQ:

Especially Q17 & Q19
Q17 - I have a CCJ will this cause a refusal?

A CCJ is not a ground on its own to refuse the application. However, the fact that you have a CCJ may be evidence that you are deliberately and recklessly building up debts with no intention of paying them back which, is a grounds for refusal. Therefore, if you have a CCJ you should include evidence that you are making repayments or that the CCJ has been paid/settled.

You can check whether you have a CCJ registered against you by visiting Trust Online. Although, if your CCJ is settled within one month of being issued it may not be registered.

If you cannot afford to pay your CCJ you can apply to the Court to vary the instalments. See Q19 if you are struggling to pay your debts.
