Date of automatic ILR for EEA nationals re field 1.3 of Ap

Post by Valmotis » Sat Sep 26, 2015 4:35 pm

Hi all,

I arrived in the UK on 17/08/2009 and lived here ever since with the exception of holidays of course. I understand that an EEA (French in my case) national automatically gets ILR after 5 years and then need to wait a further year to exercise that ILR for one year before application. I do know I don't have to have an paper for that ILR as it is automatic so here is my question:

- Should I write 17/08/2014 as my date of ILR obtention in field 1.3 requesting a date to be provide; or
- Should I leave it empty as I did not have to obtain an official paper as EEA nationals hate this automatically granted?

Let me know as this box, the booklet and the guide are of no help with this matter...

Cheers.
Tom

Salut!

Note that EEA nationals do not get ILR; they can automatically acquire permanent residence (PR) by exercising treaty rights as a qualified person, continuously, for 5 years (in UK).

It is not as simple as simply living in UK for 5 years.

In which category of qualified person have you exercised treaty rights?
Do you have sufficient documentary evidence?

One can optionally apply for a 'confirmation of PR' card if one wishes.
This simplifies somewhat the evidence to be submitted in support of an application for naturalisation.

You are correct, a person who is not married to a BC has to be free of immigration time restrictions (ie have settled status/PR) for 12 months before applying for the privilege of citizenship;
(assuming all other requirements can be met).

Bon chance!
