Cooling period for Re-applying TIER 2 ICT VISA

Post by vijenderreddymucha » Mon Sep 28, 2015 11:33 am

Hi everyone

I would like to tender my greetings and thanks to the forum members.

I have a query with respect to TIER 2 ICT LONG TERM VISA. My employer in India has processed my Tier 2 ICT LONG TERM Visa which got approved for 3 years upon a requirement in one of the client project lets say client A. COS was issued by employer with the Client A details (under Main work address in UK) as I had to work in client location. The validity of the Visa is until June 2017. I have travelled to UK and worked for client A and came back after 5 months. Now, I have changed to a different project within the same employment organization in India. Now, I got another opportunity to go to UK for Client B. I have travelled to UK and served for 4 months and came back. Due to some conflicts, my employer has withdrawn my Work Permit. I have resolved the conflicts with my org but wanted to know couple of things before I ask my org to raise new Work Permit.

Below are my queries:
1) Do in need to undergo any cooling period of 12 month in this case as my employer is still same?
2) I was issued a COS with Client A details on it. However, I have been asked to travel on the same COS to server client B whose work location is different. My sponsor is same but clients are different. Is that valid or will it comes under any immigration violation?

Looking forward to your answers.

Thanks
VJ

If your employer has already withdrawn the visa, you cannot travel on the same. You will be subject to 12-month cool-off before you can apply for any other Tier 2 visa.

Thanks for the reply.

I am just confused with the phrase "Any other Tier 2 Visa". I suspect would it be the same when applying for same Tier 2 ICT Visa and not other Tier 2 visa.

My employer has issued the Cos based on which I got Tier 2 ICT Long Term Visa. Employer has withdrawn thw Cos couple of months back. Now, if my employer issues a new Cos then will the earlier Visa validity holds good or can we proceed with new Tier 2 ICT application or do we still need to wait for 12 months.

If we need to wait for 12 months, then what could be the best alternative to get a UK Work permit. Can I apply for Tier 2 ICT Short Term Migrant?

Your old visa is now cancelled and you cannot use the same visa to enter UK. You will have to apply for a new visa for which you will be subject to 12-month cool-off from the date you left UK.

No, you cannot apply for a ICT ST visa as well. Transfer from ICT ST to LT visa is exempted from cool-off, not vice versa.
