When will I be eligible to apply for ILR ?

Post by tier2hunter » Tue Sep 29, 2015 9:42 pm

I think this was not discussed before.
Sorry, If it was already discussed.

Following is the history of my entry clearance to UK.

Entered UK on 5th April, 2014 (visa was valid for 3 years).
Company sponsorship was revoked on 2nd Nov, 2014 and they informed UKBA on same day and
got my P45 also till 2nd Nov, 2014.
Joined new employer on 1st March, 2015 and continue working for them.

As there is a break of more than 2 months (60 days) without employment, when am I eligible
for ILR ?

From my understanding, I think I have below options. Kindly correct if there is anything wrong.

I know ILR can be applied if you work on Tier 2(G) for 5 years and current employer still
wants you to continue and we can stay in Tier 2(G) visa for maximum 6 years.

As My first entry to UK was on 5th April, 2014, can I apply for ILR 28 days before 4th April, 2019 ?

OR

As there was a employeement break of more than 2 months (60 days) and my new role was started from
1st March, 2015.
Do I need to apply for ILR on 28th Feb, 2020 ?

Expert, Please suggest!

ilr is issued after being on tier 2 for 5 years and meeting other requirements of ilr, 1 of which is a min salary of £35k.
Were you issued a letter with curtailment of leave? it means was your visa end date changed after the original sponsor licence was revoked? If it was, and if you applied your new visa within the time you had a leave to stay in uk, you should be fine.

Many many Thanks iworker for your reply.
I don't know if I was issued curtailment letter as I did not receive the same when I was waiting for it more than 2 months. I applied for my new visa after 2 months from my termination of my first job and it got entry clearance to stay in UK without any problem and I started my new assignment with new sponsor after more than 3 months from my previous job.

Somewhere I studied (not sure where) if there is a gap of 60 days in your employment, you are not eligible for ILR and it needs to be continuous working experience of 5 years with a gap of less than 60 days, if any in your employment.

As you mentioned, if I did not receive curtailment letter and there was no date changed for my first visa end date, am I fine to apply for ILR on 2019 april or need to wait till 2020 for continuous employment?

you should be fine. your leave has not broken.
Your ilr application will depend on ilr rules at the time. since it is some time away, best to wait and see how the rules play out.

Thanks iworker.
I know it's a long time away from now, but want to keep option open for better opportunities as if ILR is not possible here.
