Cool off period

Hi

I came to the UK from India on an ICT visa since June 2013.Now I am a permanent employee here with the same company.

As per the rules,i am elegible to stay in UK till 2018 after which a cooling period applies as I hold an ICT visa.

In December 2015 , I am leaving the country for an year on an assignment to Europe .

Will this one year count as cool off period as my company is ready to process a tier 2 general visa after an year.

Will this one year be considered as "cool off period" even when am on an Uk employee ,on an assignment in Europe.

Thanks for the quick response .

To add to my query ,
1. Can I be in the UK pay role during the cool off period during the assignment?
2. Does cool off period only means that the person should not be in the UK during that
Period?
3. Being an employee of a UK company whilst serving the cool-off period is permitted?

i dont think the rules explicitly say you cant be a on a uk payroll, but honestly, unless you are going to norway, u dont want to be on uk payroll.
If however, u are on uk payroll, and u stay out of country for more than 12 months, u might be eligible for tax refund from hmrc.
