Handling CoS - very urgent

Post by mvasudevan1984 » Wed Oct 07, 2015 10:14 pm

Status - Tier 2 G

I decided to leave my employer by 31 OCT 2015

Now 2 company offered job

Company A - doesn't have sponsor but they applied already for me (hopefully end of this month they will get it)
Company B - Got Sponsor license in place

I gonna ask Company B to issue CoS for me for another 3 years . But i like to join Company A
When Company A gets their license - Can ask them to issue CoS for me will it be valid to apply

I just wanna use Company B for safer side -
What will happen when company B issues the CoS , Simultaneously getting CoS from Company A

Please explain how it works

Million Thanks

You cannot have two COS assigned to you at the same time. If company B wants to assign you a COS and you already have a COS assigned from company A, you need to ask company A to withdraw the COS. Once withdrawn, only then company B can assign you a new COS.

Read the T2 Guidance document, Annex A3. It has the process that needs to be followed. It cannot happen in a day!

You have to wait for the visa approval before you can start work.

By the way, what is your occupation in view of the fact that several firms are scrabbling for your you? That should be a very highly demanded skilled job. #justasking

Hello Moonlight

The rule is so weird; No point in making us to wait

Please give me reference

Thanks a lot

The rule is logical. What if your new visa gets rejected? In that case, you would be working illegally with the new employer. Hence, they allow working while the application is in progress, only in case where you are extending your visa with your current employer.

Thanks Moonlight

So I should apply while the current CoS is live (means not withdrawn)

If my new application with new CoS successful , everything will be alright !
If my new application is unsuccessful , My Old CoS will be left valid

So there is no problem in applying Change of Employment - while current CoS active , Am i right ?

Thanks Moonlight .
