Workpermit Transfer

Hi All

I am setting up new business and want to transfer workpermit for employee. Do I need to advertise the vacancy and wait for 28 days for the EU people to apply for or can I just transfer without advertising?

The person I am interested in already has workpermit with different employer and he is willing to work for me.

The position after he switches will be the same.

doubt it, must be well established business for one year min. but see what others say

There is no minimum time that a business must be established before you can sponsor a work permit, but the newer the business the harder it is.

You won't need to advertise if the role you want him for is the same as what he is currently doing, but you will have to jump through a lot of hoops to prove that your company is legitimate.

this is what I was going for when I was saying well established which is indicative of legitimate

We have noticed recently that the HOme Office have sometimes been granting work permits for 18 months when the company havenot applied for permits before, even if they are older than 3 years. But even if the permit is only granted for 18 months, it is granted, and can be extended.
