You will receive an unemployment allowance (allocations chômage) based on the following conditions:
You have not become unemployed through your own decision and you are actively seeking work
You are registered with the Pôle Emploi
You are below the minimum retirement age
You are physically capable of working
You have been working for more than 4 months

and
If you want periods of employment in another EU/EEA country to be taken into account, you have to work at least one day in France

Casa,

I thought treaty rights start after three months, not within three months. So, even if the OP's wife were to start working straight away or seeking work straight away, treaty rights would only start three months after their arrival in France. Is that not correct?

Yes and I probably worded it badly. By within 3 months I meant by the 3 month mark she needs to start exercising Treaty rights. I can't confirm whether Treaty rights would start from the date of employment if this was in the first 3 months...but I'm sure someone else can. :|

Edit: In my opinion they would be exercising Treaty rights as soon as they became employed, even if that was before the end of the initial 3 month period...but I could be proved wrong. :|

i am well aware of not asking for immigration advise on this forum as this forum is not for immigration advise
but based on peoples experinces that they have gone through in there immigration matters.any way as casa said the exercising of treaty rights starts at the day when EU citizen get employed so i can then assume that claiming benifits before that will not effect the carte de sejour ???

You have been working for more than 4 months
and
If you want periods of employment in another EU/EEA country to be taken into account, you have to work at least one day in France

It appears that in order to claim benefits in France you would need to have been working there for at least 4 months. If you want to continue to claim benefits in France following unemployment benefits being paid in the UK, you would have to work at least one day in France to qualify.

So from that know its clear that for claiming benefits in France The EU citizen should be employed for 4 months
to claim benefits from the government its the same as UK.As they have recently changed the rule for EU migrants that they cant claim benefits for first 06 months of there arrival in UK correct me if i am wrong?
