DO i Need to apply for PR

Post by Saffa1984 » Fri Oct 23, 2015 1:10 pm

Good Afternoon,

I hope you can help.

I got married in Sep 2008 to an EEA Citizen and divorced in May 2014, I applied for ROR and received it in July 2014. With applying for ROR they issued me with a new EEA2 sticker in my passport thats valid until 2018.

My questions is:

1. Do I need to apply for PR (EEA4) now because I have been in the UK for more than 5 years married and exercising my rights after divorce or can I stay on my current visa till I have been in the country for 6 years and then apply for my British citizenship?

Any help would be greatly appreciated.
Kind Regards,
Saffa

Will depend on whether EEA nation was a qualified person during currency of your marriage.

Criteria for ROR, is not quite the same as for PR.

Thank you for your reply Obie.

My partner lived in the UK uninterruptedly since 2002, I have proof (that I used in my ROR application) showing that he exercised his treaty rights for more than 5 years.

I have also Payslips and P60's to show that I have worked for the last 5 years.

One other thing that I am not certain on is that just before we were divorced he took a sabbatical and went travelling for about 9 months travelling in Australia and Asia, came back and decided we were over and then went back to work after that. I do think if you exercised your treaty rights for 5 years or more you automatically qualify for PR as long as you don't leave the country for more than 2 years is that correct?

Thanks again for your help.

Kind Regards,
Saffa

Hi there
I have got a question related to eu national.
One of my senior colleague came from Italy. He has got Italian passport. He wants to stay uk permanently .
Can anyone please advise me what's the procedure to follow?
I found 2 forms EEA(qp) and EEA (FM) but not sure which one
to apply.
Many thanks in advance
