Hi Friends,

My wife's tier 2 general dependant visa has expired recently and she is out of UK as of now. she had to leave in an emergency and hence we couldn't apply for her extension.

it will be more than six month (in jan 2016) when we would be applying for the new visa in the same category as tier 2 general dependent.

my question is , will this break affect her continuity in terms of ILR since there was a gap in active visa status .

Yes, "continuous leave" is a requirement for qualifying residential period for settlement (319E(d)).
