Makeing a claim for JSA when partner has NRTPF

Makeing a claim for JSA when partner has NRTPF

I need to make a claim for jsa, i am british and my partner has no recourse to public funds, i did this before a couple of years ago when we couldn't find any work and was paid the single persons rate, the problem is i cant remember how i approached the issue when making the claim on the phone, what i want to know is.

1. when making the claim do i say i wish to make a joint claim for jsa whilst stating my partner has no recourse to public funds and i wish to be paid at the single persons rate?.

2. Or do i just say i wish to make a claim for jsa (not mentioning the word joint) and just notify them that i have my partner living with me they have no recourse to public funds and i wish to be paid at the single persons rate of benefit?.

I know they both sound the same but i cant remember how i approached this last time am i right in thinking that when 1 person in the couple has no recourse to public funds then it cannot be a joint claim? please guys i need help.

Are you talking about Contribution Based JSA or Income Based JSA?

Contribution based JSA would be in your name only as it doesn't matter if you have a partner or what they earn, as you get this in your own right for maximum of 6 months.

If you haven't contribruted enough and can't get CB JSA, have you checked to see if you are in an area where Universal Credit has already replaced IB JSA? That has different rules.

Are you talking about Contribution Based JSA or Income Based JSA?

It will be income based JSA for me i am British our child is British and my partner is Brazilian with no recourse to public funds, universal credit is in our area but it is only for single people at the moment we have a child and i pay maintenance for another so at the moment would be ineligible for UC.

I just cant remember how i worded it to them the last time i claimed as i explained above.

There is no income at the moment as my partner is not working either our child is 3 years old.

In my area Universal credit is for single claimants only with no children and people who don't pay maintenance through the csa.

Can you just refer them to your previous claim and tell them you still can't take extra benefits for your wife as she is not allowed these?

I can't see how you can make a single claim when you are not single as they will still need to check if your wife is working or has savings and you need to sign the declaration.

If you are claiming working tax credits then you will need to tell them that you are not working, to avoid any overpayments.

I assume you know your Tax Credits claim must be in joint names? And your child benefit must be in your name only?

Hi again thanks for the help yes i am aware of the tax credits and child benefit so you think option 1 in my original question is the best way to approach it?

What is the difference between a joint claim and couples claim?

i live in the uk but have read this i know its northern Ireland but it must be the same here in the uk right?

JSA joint claims
You must make a joint claim with your partner if all the following apply:

you both want to claim JSA
one of you are 18 or over
you’re both under state pension age
neither of you are responsible for a child


We have a child under 5
