ILR Query for NewBorn

Hello All,

Need some help regarding ILR for my newborn son.

I'm currently on Tier-1 and going to apply for ILR in June 2016. My son was born in UK in May 2015. As my wife wanted to go india, I applied for Indian passport and Tier-1 dependent visa for my newborn son. They are in india since Aug 2015 and won't be coming till end of January.

What options would I have for him when I get my ILR? do I have to apply ILR for him? or British passport\naturalisation? Considering he will be out of country for about 6 months?

You could register him under section 1 (3) after ILR has been obtained.

What about staying out of country for 6 months? is it irrelevant for minor?

I could be wrong, but I believe that there is no need to even apply for ILR. Provided the child has a valid visa to re-enter the UK and till you get your ILR, you can register him directly under Section 1(3), which is an entitlement (i.e. can not be refused), after you get your ILR.

Will you be getting your ILR via 5 years of T1G or 10 years LR?
