hi all,
my faince recived 1000 pounds in repayment of income tax, my question is if we can use it as income towards meeting the Financial Requirement.

her annual income is more than the required but the problem we have is that her income in the last year wasnt just salaried becuase she was reciveing maternity allowance. and only been working for almost 5 months with this company. and combiend was are missing about 150 pounds (18,450) for this years 12 month income so we really need that 1k to be counted.

will appricate any advice, thank you.

You will not be able to do that.

The 1k is a repayment for excessive tax.

However, in calculating her income, only her gross salary was counted, so the overpayment had no bearing, as it did not affect the calculation anyway.

i defently see your point there about the calculating of her income but i dont think its related to tax from her current job. as its a repayment of tax from 2014-15 so it will be regarding her old job which wasnt calculatied in the 12 months.

is there no chance of consedring it as income?
is 150 pounds are really a deal breaker for the officers? is the fact that she couldnt get any income to be condsiderd in the 9 months of maternity and now working hard and earning 35k dont metter ?

i have an update, i recalculated the maternity allowance and it seems that i forgot a week, and that it was 40 weeks and not 39 as i thought. which mean we are only missing 4 pounds (18,596).
so going back to me previous question if you think that becuase of 4 or 100 pounds the officer who looks at the case will automaticly dissmiss it ?

also i found this:
"(i) a period of 6 months prior to the date of application or to the commencement of the maternity, paternity or adoption leave, if the applicant has been employed by their current employer for at least 6 months (and where paragraph 13(b) does not apply); or (ii) any period of salaried employment in the period of 12 months prior to the date of application or to the commencement of the maternity, paternity or adoption leave, if the applicant has been employed by their current employer for less than 6 months (or at least 6 months but the person does not rely on paragraph 13(a))."

in the FM-SE appendix.
but i dont see how can i add it in the VAF4A-appendix 2, or is it just simpley attaching the payslips and contract of the employer that she worked for prior to the maternity?

sorry for all the bumping its just really important for me to be sure of our options to meet the financial requirments.
