Tier 2 Dependent Extension Urgent

Post by pkotagiri » Fri Nov 13, 2015 10:51 pm

Hi All,

I'm on Tier 2 Visa General and my visa expires on the 22nd of December. I'm applying for an extension on the 1st of December. I have 2 dependents. Both my dependents are out of country. My husband had to live in the US because of a business from the past 2 years. My baby is with my parents back home in India from the past 2 months. My baby was born in the UK nd for both my dependents we are not worried about the ILR clock of 5 years. I'm sure my husband's visa will be approved when he applies in the beginning of next year. But I have questions around my son's application. I've listed them below

1) Can we apply for my child's visa extension from India? I'm planning to apply immediately after my extension. But my husband won't apply until the beginning of next year. Will that cause any impact on my son's visa?
2) Is there any risk involved if applied from India?
3) Tier 2 Dependent visa application form for my child contains questions around both parents. Questions like are both parents in the UK? My husband's leave expires end of December but he's not living in the UK from the past 2 years. But I'm the main applicant and earn nearly 40K per annum. My husband supports me financially and we are still in a happy marriage. He had to live outside of UK purely for business reasons. Will this cause any problems when my son applies from India?
4) What should I answer for questions in the form like "Do both parents live in the UK?"
5) Do you recommend that I bring my son to the UK before his leave expires and apply for an extension from within the UK?
I'm really confused about my son's visa.Any thoughts will be highly appreciated. Thank you.

They cannot apply for extensions from outside the UK.

Husband (and, therefore, child) may face problems.

Recommend that both husband and child return to UK before expiry of leave and apply for extensions In the UK with you. Evidence of subsisting marriage may be required.

Hi Vinny,

Thank you for the reply. If extensions can't be applied from outside, will it be considered as a new application?

And what would be the proof for subsisting marriage?
Will recent pictures from holiday be good enough?
