Post by Bamtexltd » Sat Nov 14, 2015 9:40 am

Hi
I applied in April 2013 FLR(O) on basis of family court case for child access.Leave was granted in june 2013 but for 2.5 years on 10 year route through my solicitor, but now I want to apply my extension this month and i have some question to ask on how to fill the application form, can anyone help me with this questions
1. Do you have sole responsibility for their upbringing? Yes or no
2. Does the child normally live with you and not their other parent? No because she live with her mum (my ex partner)
3. Do you have access right to this child? Yes I have court order

Court Order on its own will not be sufficient in these cases, the rules prescribe that something more than a mere court order is required.

Obie is the authority on this.

Financial commitment evidence, letter from GP or health visitor that you attend hospital appointment will be helpful.

Hi obie,
I do transfer money from my account to her mum account when she need money for her for example when she's going on holiday, I transfer money to her mum account for holiday, I organise a birthday for her.
In aspect of letter from GP or health visitor, my daughter doesn't live with me, she live with her mum and her mum do take her to GP and health visitor, I don't think I can get that, anyway I will ask her mum if she can help me with that from health visitor or GP.

I am just advising based on the guidance and the evidence required and the wording of the law, if for any reason you are unable to provide the required evidence, it is open to you to write and explain this and see what the caseworker will make of it.
