General Visitor Visa

Post by sravs » Sun Nov 15, 2015 5:15 pm

Hi Friends,

My Mother has got UK visitor visa (6 months) valid from Nov 2015 to Apr 16. But she couldn't travel in Nov but planning to come to UK in Feb 16. As the current visa is valid only till April, I am thinking of applying for VISA again fro the period Feb to July 16 so that she can stay here with us for 6 months. Can I apply again when the previous VISA is still valid?

Thanks in advance.

Having a visit visa of six months validity doesn't mean you can stay six months on it. That's never a good idea since it fails the 'genuine visitor' test.

How long did she state on her visa application that she was going to stay in the UK?

Hi Vinny,
Just had a look at the application that we applied last time. I don't see any column asking for duration of the stay but a question on start date.

It's a standard question:

Hi Vinny,

Thank you. Yes I see now, we have mentioned 6 months stay. But my Mother hasn't travelled as planned. So, thinking of reapplying from Jan/Feb to Jun/July 16. As said, the current visa is valid until April. Will that cause any issue?

Be aware that the UKV&I is looking very closely at applicants who stay in the UK who appear to be residing in the UK in the guise of visit visas. Here is a recent story on these forums.

A six month visa does not mean that the applicant is expected to stay in the UK for six months, but that they can come to the UK for a visit any time in the six months. I think that if you were to reapply to change the dates, that would certainly raise doubts on her intention for visiting the UK as opposed to living in the UK.

And not only do you run the risk of having the new visa refused, the current visa can be curtailed/cancelled and future visas can be refused. I would urge extreme caution.
