Tier 2 ICT to ILR 5 years residence

Post by sp124_nitk » Mon Nov 16, 2015 10:53 pm

Hi-

I have moved to UK on May 2010 under Tier 2 ICT (long term staff) where VISA issued after 6 April 2010. I am staying in UK past 5 years, Am I eligible for ILR? As per my search I am not eligible to ILR even though I completed more than 5 year.
Can I switch to Tier 2 General without any glitch if I find some sponsors?
Do I eligible to apply for ILR after that switch straight after or do I need to wait for sometime? How long do I need to wait? Does my stay in UK reset to 0 after I switch to Tier 2 General.

Kindly help me on this.

Thanks
Shiva

When did you APPLY for the visa? That is what determines if you are pre- or post - 6th of April 2010...

After 10 years of residing in the UK, you will be eligible for 10 years long residence, provided you meet the absence requirements. So sometime in April/May 2020.

If you switch to Tier 2 General (which you are allowed to do without serving the 12 month cooling off period because you have had continuous stay on a visa originally issued between April 6, 2010 and April 6, 2011, provided you apply within the UK), you will need to have 5 years in that category.
