Hi,
I hope someone can help me with a few questions I have please.
I am an EEA citizen living in the UK and my non-EEA spouse lives with me with a family permit. We have applied for a residence card around 3 weeks/a month ago and have requested all our documents back. We did a biometric around 10 days ago. All the documents have arrived back today. My questions are:
1. Does requesting ALL the documents affect our application in any way?
2. How will they issue the residence card without my spouse's passport?
3. Will they ask me to resend her passport?
The person in the Home Office I was speaking to told me that it will not affect my application and they do not need the passport because since last April the way they do it is to give a physical residence card like a driving license. There is nothing on the passport. I tried to look for more information on this but could not find much - is what this person told me correct?

Regarding your question 2.
RC has been issued as a separate card since April 2015. Nothing on passports.
To your question 3.
When you request your passport back, you are supposed to receive a letter by Home Office, saying do not send it back unless they ask you to. And most of time, they don't.
To your question 1, I don't know but I'm really curious....
Can't help wondering if you request ALL documents back in such an early stage, what material do you expect your caseworker to work on?

Well the home office person told me they take copies of everything so I am assuming that is what they will work on.
If anyone else can also help me with question 1 that would be a great help!

Hi my partner requested his passport back coz he needed to travel for work he is German, I've been waiting for my BRP for 3 months. I would like to know if I can request my passport back (I'm a non EEA) to travel abroad, and when I get the visa anyone know if I get any stamp on my passport?

Hi,

Now I am not sure whether our application has been withdrawn or whether it is still in progress? Is there any way to find this out?
I called the Home Office but the people are not very helpful and every person tells me something different. Is there a way to find this out for certain?

Hi,

The documents were returned with a letter saying that we should not send the documents back unless they ask us to.
Question: What would happen if I DID send my documents back next week even thought they told me not to? Will this have a negative effect on my application? Will anything happen? Has anyone had any experience with this?

It will all depend on the request you made on the online form. If you requested travel document only, then only travel documents would have been returned.
If you requested withdrawal of application, than unfortunately that is what you will get.

If indeed you did not select the option of returning all my documents , then you ought to write to the borders agency to seek clarification of the status of your application .

I had requested all my documents to be returned to me - they sent me all of them because I asked for all of them.
My issue is whether my application is withdrawn - which I did not authorise in the form I filled in here: eforms.homeoffice.gov.uk/outreach/Progress_enquiry.ofml
In the enclosed paper with the returned documents it says "Please do not return your documents to the Home Office until they have requested by a caseworker."
Does this not imply that my case is still ongoing?

If my application for a residence card is withdrawn, am I supposed to receive a confirmation letter or email confirming that my application is withdrawn?
