Immigration officer advised wrong.Applied again.Return Pass?

Hi,
Our case is a bit special because my husband applied middle of October for the FLR(M) form as we were advised wrong from the Immigration office. I am german and my husband is turkish. My husband has got a tourist visa and we got married beginning of October. Before we got married we called the Immigration office to get info. So the lady told us to apply for COA and then FLR(M) After applying for FLR(M) No one contacted us to tell we applied with wrong form. So we booked our christmas holiday 18.11.2007 and we got the rejected application on the 19.11.2007 from the Imm.Office. We were shocked. So we called the Imm. office and the guy told us that were advised wrong and we had to fill out EEA2. Which is free. Besides this we paid for FLR(M) 500 pounds and for CEO 300 pounds.

So we applied on the 19.11.2007 again for EEA2 and we also included a letter explaining everything what happened. Our flight is on the 26.12.2007 but at least one week before the date my husband needs apply at the german embassy for german visa. I put everything in the letter.

Can you tell me what you think about our case?
Also do u think they will treat our application special as it was their fault. Because FLR(M) decision time takes 4-5 weeks and thats why we booked ticket.
ANDD do you think there is way to get our money back for FLR(M)?
