Hi Everyone,

I got married 2011 and got Stmap 4 Euafm in September 2011 to september 2016 , due to my passport expair september 2015 they give me 4 yars visa in passport which is over now . i went to immigration with my wife And immigration officer Register me now i am waiting for Garda card , I also told officer that my wife is going to her country for 8 to 9 week for rehabilitation center as she was drinking lot. we are living 4 years together.
immigration officer ask a letter form her rehabilitation center, my wife was agree to send a letter for showing she in joining rehabilitation.

Now when she went to her country she had a big fight with me , Now she want i divorce her , If i divorce her now . can i stay in this country in my own rights ? we are married nearly 5 years . Can anyone advise please .

Yes you can divorce her, but this may affect your right of residence if she has not acquired permanent right of Residence in Ireland.

Thank's for Reply. No she was working 3 and half year in ireland & 1 year did Enflish Course. and i have all p60 and collage lettres , Joint Name Bill in Home.

You can only apply for EU5 with a divorce.

The Garda is wrong to refuse to grant you extension, as you are a family member until you are officially divorced.

You need to write to the department of Justice to inform them that you are still married, but marriage is having difficulty and garda are refusing to grant you the remainder of your visa.

That the Department and Garda will be in breach of EU law, as you are a family member until officially divorced, and you can't be refused that right because your wife could not accompany you.

The Garda is not Refusing me for extension, i went to garda with my wife only week before , and Garda Ragister me , take my photo for GNIB Card , and told me will ring me for stamp my passport and card but i need to Supply a letter form my wife rehabilitation centre as she will be in her country another 8 week for rehabilitation , After that i got problem with my wife , I havn't inform Garda yet .

but i dont think Garda will Give me The GNIB card now after inform them, they might make problem.

Well be truthful yell him thing are not going well with your wife and that you had a dispute . If he refuses to give it, then you have a case.
