Tier2 to EEA Family permit effect on ILR

Post by immquestion » Mon Dec 14, 2015 12:33 am

Hello everyone,

I am currently in the UK under a Tier2 visa sponsored by my employer. It has been the case for almost 4 years which makes me close to the 5 years requirement for the ILR.

I am also planning to marry my Fiancee who is a French citizen in the coming months and ideally would like to switch from my current Tier2 visa to an EEA Family Permit (mainly for work flexibility reasons).

Would switching from Tier2 to EEA Family Permit require me to start again a full 5 year period for the ILR? Or would the previous time spent under Tier2 (almost 4 years) still count and hence require me to stay on the EEA Family Permit for about a year only before I can apply for the ILR?

Thanks

To qualify for ILR under the PBS route, one must be in the UK under UK immigration laws .... not EU directives.
