Dear all,

I am looking for advice here. Any help will be much appreciated.

My daughter was born in the UK in 2010 when I was on work permit. I subsequently got my ILR in 2012.

My daughter went back to India with my wife (both Indian) in 2011 but came back to the UK in 2013 on dependent visa (daughter's visa is dependent on my wife's visa! > dependent on mine!). I understand my wife has to compete three years before applying for ILR. My question is whether my daughter can apply for British citizenship now? Or does she need to wait three years to get ILR first.

As she was born in UK, your daughter can be registered as a citizen under section 1(3) of BNA now that one parent is settled.
