1) is it compulsion that I have to tranfer my ILR stamp to my new passport

2) if not can I apply for schengan visa using old and new passport, I have to visit France in jan 2008

3)can I apply for naturalisation without ILR on my new passport?

It is not compulsory as far as the UK authorities are concerned, and you don't need to get it transferred for the citizenship application.

As for the French, I'm not sure. They can be a bit funny about these things. Perhaps someone else will know...

I was in a similar situation with my Limited Leave to Remain (HSMP), ie passport about to expire. I was told I didn't need to transfer the visa and I could just carry old passport (with visa) + new passport (without visa) stapled together. I could imagine the hassles stapled-together passports would create in some countries and airports!

I was due to extend my visa a few months later so managed to line up the timings so the new visa could go in the new passport.

If you will be on ILR for a while, it might be worth transferring it to avoid hassles.

See also Application forms:
You can travel with a new valid passport or travel document without having your leave transferred from the previous passport or travel document provided that you carry your old passport or travel document with the endorsement of leave or the letter in which your leave was granted.

It is up to individuals to ensure their travel documents are kept up to date and are valid for travel. The decision to admit a person at port is made by the immigration officer based on the information and evidence presented to them.
