Naturalisation app affected by previous decisions?

Post by nibimusop » Sun Dec 20, 2015 12:10 am

If there has been previous rejections (for ILR - HO claimed bad character), but then reapplied (with issue explained) and then ILR granted, will this affect the citizenship application? Or is it OK given the issue was resolved for the ILR app

Applications for the privilege of citizenship fall under different legislation than for UK visas.
This means different standards and rules apply.

Circumstances (or exceptions) that may be acceptable for the granting of a visa may not be accepted when it comes to the question of granting citizenship.

For example, see HO guidance on 'good character' to understand the sort of checks & factors that are involved:
https://www.gov.uk/government/uploads/s ... _D_v02.pdf

And this HO guidance discusses UK revocation policy (for the most serious cases):
https://www.gov.uk/government/uploads/s ... t_2015.pdf

Ofcourse the 'devil is in the detail'.
It all depends on the details of a particular case; also on the law in force at the time.
And, if discretion is permitted for some particular aspect of the application, it will depend on the caseworker (or senior caseworker/manager) responsible for handling the application.
All that is gold does not glitter; Not all those who wander are lost. E&OE.

Well you just have to take your risk and chances. I think it is 50 50.
