I am a New Zealander who will be applying for HSMP and EC next year. In July 2003, in New Zealand, I was convicted of drinking and driving causing injury. The sentence was community work, a fine, and disqualification from driving for 12 months. This is my only conviction.
By the time I apply for EC, it will be more than 5 years since I was sentenced but less than 5 years since I paid my fine, completed my community work, and finished my disqualification period. I now wonder whether my conviction will be considered "spent" five years after the sentencing date, or five years after I paid my fine, completed my community work, and finished my disqualification.
My question is: Will my conviction be considered "spent" if I apply for EC more than five years after the sentencing date, or will I have to wait until 5 years have passed since the date I paid my fine, completed my community work, and finished my disqualification period?
