Hello everyone in the house, I am happy that i finally join this forum after being a ghost reader for while. I need help from everyone in the house for your candid advise or your experience about my case please. Here is the breakdown of my story.....

I am a Nigerian citizen, I came to the UK in 2010 as a visitor but i overstayed my visa and never go back. In Nov 2010,I met my partner who just got her ILR then,she is also Nigerian. We started living together from 2011,She got pregnant and God gave us a beautiful daughter in May 2012. I seek an advise from a solicitor about my leave to remain and he made an application for me in June using flr fo form on basis of article family life. But unfortunately my application was refused without appeal in 2013, based on the new law and also stated that we are unable to provide 2years proof of living together. My solicitor fight for a removal,so we can get an appeal,but all in vain. I was told from another solicitor that i should put in another application,an this time,we need to get all the 2 years proof of living together. But its so difficult to provide all these proof,because of the share house we were living. So we decided to rent a flat,in 2014 my partner got a 2 bed house to rent from a friend,but to my surprise,my partner change the whole tune of the music to her favorite one. My partner got the house on her own name,claim housing benefit on the house because of her low income,put her name on every utility bills in the house,and told the council that she and her daughter is living alone. This caused me a lot of problem and eventually,it led to our separation in may 2014. I do see my daughter and also picking her from the nursery and also following them to any appointment they have from the jp. In Aug this year,my i made an application with a solicitor on family life as parent,HO sent a letter to my solicitor asking for more document like; DNA test,my ex ID to confirm her signature on the letter she wrote,my ex tenancy agreement/council tax bill,a print out copy of my child medical report that shows all the appointment attended,my own tenancy agreement/council tax bill and utility bills. I have got everything ready,except my own tenancy/council tax,as my solicitor told them i was living with a friend,and my friend also write a letter confirming that i was living with him since the misunderstanding between me and my ex,and he include his ID and a copy of tenancy agreement/council tax bill. my solicitor has sent it back last week,we are waiting for a positive reply by God grace.

Here is my worried, my partner want me back seriously,we've being on it for two months now,she said i should come back and start living together as a family with our lovely daughter,which i am happy about as well,because there is nothing like a happy family. My question is;If by God grace, i have being granted leave to remain on basis of what i applied for,will this not affect me if i want to renew,now that me and my partner are about to be living together again? And what should i put the renew on,is it on parent or partner? And more so, if we started living together will it no affect my partner's housing benefits/child tax benefit? and will her benefits not affect me if i want to renew again? I am totally confused.

Please guys,your candid advise is needed,I will be very grateful to hear from you guys. Please,don't mind my long story please,just want to make it a bit clearer. Thank you all,God bless you.

Recently I have been granted Flr Fp based on my wife and step daughter..You should get your DNA proof of yor child and apply parent for british child am sure you will get it..Wish you all the best

If you get back together, and the visa is approved, you will cease from qualifying under the parent route, and your leave could even be curtailed.

@ Karan,I have done the DNA at ddc and I have sent the result to the HO together with other documents they requested for.

@ Obie,please what should I do on this issues,since you've advised that I may not be qualified under the parent route if we are living together,and my leave could be curtailed. Please any advice on what to do. Because if I should apply as a partner,my partner is on low income an also getting housing benefits. I am a confused man now. And I want to be together with my family,especially for the sake of my little daughter. Any more advice will be highly appreciated. Thanks guys God bless you all.
