Tier1 Dependent visa(expired) to Tier2 general visa from Ind

Hi Friends,

I want to get few clarification on Tier 2 general visa from India.

I got married and came to UK as Tier 1 dependent and worked in IT for 1yr,
met an accident on the day of expiry of the visa and took medical leave and went to India,but i didnt inform this to my employer
as i thought my husband will extend the visa after my treatment,but unfortunately me and my husband split up,he did not extend my visa.
But my company paid salary(they did not check my visa expiry and paid 3 months salary after my visa expired),also i worked from home to the same company
during the treatment until my resignation.

1)Can i apply for Tier 2 general visa from India(Please note i already resigned the job now,my employer don't have sponsorship license)

2)3 months salary after visa expiry is the problem to apply visa(it was considered as medical leave only by the company)

3)Will it considered as illegal working, those 3 months medical leave period?(I have provided medical certificates to the employer)

1. Yes.
2. Since you were working under dependant leave, there was no sponsorship involved. You left UK before your leave expired. You were on medical leave authorised by your employer. That you were outside the UK and worked from outside the UK is not HO's concern.
3. No.
