Spouse visa Extension-Absence from UK

Post by PariJ » Wed Jan 06, 2016 2:39 pm

Hi ,

I am currently in UK on ILR and my spouse is on Spouse settlement Visa due for renewal in march 2018.

My employer has requested me to work from Poland office for a year. I am wondering whether this temporary relocation will affect my spouse visa extension or ILR continuous residence requirements when we are back to UK. I presume this relocation should not affect the eligibility for naturalization in the future.

UKBA guidelines clearly states the ILR requirements for other visa category but not for Spouse settlement.
Appreciate your inputs.

Cheers

As a rule don't presume anything when dealing with HO.

ILR can be revoked by HO due to a 2 year absence from UK.

There are various requirements to be met around absences when considering the privilege of citizenship.

Excessive absences can result in refusal.
For example, in the 12 months before applying for naturalisation absences should be limited to 90 days.

See the relevant HO guidance within booklet:

- see Section 5, page 7+
