Dependant visa mom left without making indefinate leave!!!!

Dependant visa mom left without making indefinate leave!!!!

I'm on a dependant visa, I arrived in the UK in 2004 January and my mom has been here for 5years 5 months but now she resigned a month ago and took another job from my country of origin and left me here without a indefinate leave to remain although she qualifies for it. Is it possible for her to come back and apply for it so that I can be sorted. She's still got a work permit expiring in 2010.

Unfortunately, after your mother resigned and left the UK, she no longer qualifies for ILR because paragraph 134(iii) of the Immigration Rules is not met.

How old are you? What is your current status, and why didn't you return with her (since you were on a dependent's visa)?

Since she has left her job, the work permit is no longer valid. You mention she has been here for 5 years - was this always on a work permit? When would she have qualified for ILR?

I am 19 years old and still on a dependant visa. I am a student and am about to finish my BTEC NC in IT, my goal is to work after I finish college, but I fill that my career would progress better here than back at home.

Yes, she was always on a work permit during her stay, and she has already qualified for ILR in June 2007 but did not apply for it.
