Tier 4 dependant to Tier 2

Post by Deepakps12 » Mon Jan 11, 2016 11:00 pm

Hello all,

I'm working in the UK for the past 6 months as a Tier 4 dependant. My employer wants to sponsor a Tier 2 G for me. But he is unsure if I can switch as I have already started working here.

Should the Restricted COS be assigned only to a new job offer? Can the employer perform RLMT and sponsor me even though I have been working with the same company as a Tier 4 dependant for 6 months?

Thanks in advance.

he will need to perform rlmt , issue restricted cos.
since you are tier 4 dependent, you can apply within uk.

Thanks mate. So it does not need to be a new offer letter? so let me summarize,

1. I Can continue on the same job.

2. My employer needs to do an RLMT on this job role I'm working on?

Thanks,

for a visa application, you dont need a contract.

they need to advertise the job, show how they have tried to find a suitable person, and record all actions including any applications received or interview they do.
after that they issue you a cos with start dates of future (say the rlmt is complete by March and they get cos in april, and they are issuing you a cos, so they insert (say) may date). this would not mean that they falsifying that you are starting the job with them then, rather it means that they are starting to sponsor you from that date.
you should also read the guidance to understand the policy and guidance.
