Tier 2 Role change / Promotions

Post by rkc1981 » Mon Jan 11, 2016 5:00 pm

Hi All,
I am being offered a promotion by my employer from a senior engineer to Manager within the same department. My current role is no longer under shortage list. My question is should my employer apply for a new COS under the new role title. Should they also do the market test as the role title is now different?
I have been with employer for 4.5 year and due to ILR shortly. How will this effect me?

Thank you

Based on my understanding of reading various posts on this forum, if you decide to accept the new role, then you need new cos & RLMT. So the best thing to do it complete 5 years on your current visa and role, apply for ILR and once you get ILR move into that managerial role. I think that would be much more sensible option. Try to discuss with your employer and see if they are happy to go in this manner.
My advice is based on personal research/experience, so pls check relevant UKVI sources.
