Entry Clearance - With USA visa denial

Entry Clearance - With USA visa denial

Hi,

I've just got my Workpermit :)

In the VAF2 employment form Part 5

5.2 Have you ever been refused a visa for any country, including the UK?

I've been denied a US visa before. The consult is not convice that I have a stronger financial ties.

Should this affect my EC application chances?

It shouldn't!

I know someone who was applying for EC who was once refused a visa to Canada a few years before (also, because of weak financial ties), but was still allowed to come to the UK.

I guess it's partly because their financial situation had greatly improved by the time they were applying for the UK visa.

But more importantly, I think it's because they were honest about the refusal, which I think you should be too. Otherwise you risk losing EC altogether, if they catch your deception.

BTW my tourist visa denial was in 2002... In 2004 I got an L1 (Intra company visa) from my company... and got another L1 visa from another company last 2006

5.2 have you ever been refused a visa for any country, including in the UK?

Reason for denial: No strong ties.

*Note In 2004, 2006 I was issued an L1 visa (Intra-company-transfer)

can I add this note in my answer?

Was the L1 issued for the US? If it was and I suspect it is, then you would have to put it there to say yes but the IO would see that since then, your circumstances had improved and the same country which refused your initial application granted you a visa the subsequent years!

Yes the L1 is issued by the US...

In the denial details should I put that I now have an L1?

Do I need to demontrate strong ties for the EC?

I think that "strong ties" may be considered when the applicant is required to show intention of leaving the UK at the end of a limited period. As work permit holders may later apply for ILR (indefinite leave to remain), it should not be necessary.
