(CHANGING VISA FROM TIER 2 (SHORTAGE OCCUPATION) to TIER 2 WITH THE SAME EMPLOYER)
Hi everybody, I am posting on behalf of somebody
Friend of mine is currently working on Tier 2 General (shortage occupation) since August 2015 but he has been offered another job from the same employer which is not on shortage occupation but he is very keen to take it, according to home office guidance new application has to be made in this case,
But according to the paragraph 73 of the tier 2 guidance he can't apply for another tier 2 within 12 months of his last tier 2 visa.

He can apply for the new job from within UK and the application will be considered as same as any other switching job application. The employer will have to conduct the RLMT as per the guidance and ensure that its carried out properly so that it does not look like he is pre-selected for that job (which the home office will surely think of since he's from the same organisation).
