ILR (TIER 2 General)- impact of 3 month EU study break

Post by bot » Tue Jan 12, 2016 8:45 am

Hi

I have been in the UK for 4 years on a tier 2 general (sponsored) visa. I now have a potential option of attending a 3 month study programme in Italy from Sept to Dec.

If I take a 3 month sabbatical to attend the programme in Italy is that OK - i.e. will it not influence my ILR application in a year's time? As long as I comply with the general 180 day per 12 month period requirement? Or is the fact that its not an absence from the UK for purposes of my tier 2 job an issue? I can argue that the academic programme will help me with my UK tier 2 job.

Thank you

As long as you are not away from UK for more than 180 days in 12 months and your salary is paid in UK when you are away from UK (for study or work ), I can't see any problem.
You can wait for expert advice if you wish.

thanks...yes problem is I'm unlikely to receive a salary for those 3 months (at most a small part of my salary).
