NOT REQUIRED TO LEAVE BUT NO APPEAL.

Post by napepe » Wed Jan 20, 2016 3:28 pm

I need some help last resort before I leave uk have suffered too much...

decision: refusal to vary or variation(para 322(3) of HC 395
In compliance with reg 2003 section 105 act 2002

Date of decision; june 2004

Last 2 paragraphs in notice of decision letter say: There is no appeal rights.

you are not required to leave UK as a result of the decision, but if you don't leave action may be taken to enforce your departure.

Alleged reasons of refusal; violated 5n conditions as was working and late application which is not true as I did apply in time and have evidence.

I came to study in 2003 full time and paid all year tuition before coming to uk

I have ever since lived in UK for over 12 years just surviving productive life ruined really, I had nothing to go back to in Zambia but its harder now. Have been studying a professional course on my own just something to lean on

All the lawyers I saw have always said had no chance a few months after refusal wrote a letter to enlighten Home office which I didn't follow through because I thought was gonna make case worse.

AM I AN ILLEGAL OVERSTAYER ?? and DO I FIT IN ANY CATEGORY TO APPLY REGULARISE MY STAY ???

Any assistance will be greatly appreciated.

What do people do here to get their topic responded to, is there a trick, my post has over 120 no response and have some less 100 views a few responses. Are some topics very important than the other.

Your case is complicated and obviously among those views, no one had the answer to your situation. Even the 'several lawyers' you spoke to couldn't help. I'm afraid I can't either. :|

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
