Tier-2 Employer license might get revoked

Hi..I am currently on tier-2 general visa. I am on holiday at present and will be returning to UK on 10th of February.

While on holiday, UKBA has done some checks about my employer last week and my employer told me that UKBA was not happy with some of the things that my employer is doing and they will make a decision soon about whether to revoke the license.

Let's say if UKBA comes back on 1st of February and cancels the license of my employer, Will I be allowed back into the country at the on 10th February after i finish my holidays. I know if you are in the country, you will have 60 days to find another employer. But in my case, will they allow me back to find another employer?

As per T2 guidance, if a sponsor's license is revoked, all existing sponsorship will be curtailed to 60 days OR totally cancelled depending on your role in the reason of revocation (Read sponsor's guidance for more details). It also states that if someone has not traveled to UK yet or just traveled, they will be refused entry to the country. I'm not sure which category you fall under - 60 day curtailment OR entry refusal.

Would request seniors to comment on it. I personally think you can be allowed in the country for 60 days since you've already been here and has a setup in place.

Hi devanasrikanth,

I am sorry to hear that but the normal practice is that they suspend the licence first and give u 21 working days to submit your reply. Once you provide all the requisite info they then decide whether to reinstate or revoke your licence.

However, if they see an employers as a potential threat/risk to immigration control or if an employer is breaching the rules they take strict action and can revoke the licence which in your case didn't happen. Let's say if they even suspend your licence you can still return to the UK.
