Interested in applying for HSMP

Post by memoona » Sat Dec 08, 2007 8:25 pm

Hi,

I am in the process of applying for HSMP. I have been in the UK for nearly 2 yrs now. I have done my BSc and my Masters from here.
My query is that if i get the HSMP letter can i have my parents as my dependant. My case is different than others in the sense that My dad is 52yrs. he is mentally not well, have been on medication for 5 yrs now. He cant work anymore. My mother is 40. she is not very educated and takes care of my two brothers. one is 12yrs and other is 17yrs. Their only source of income is rental income.
I want to know if i can have my parents as my dependants under these circumstances. and if my brothers can also come with them. I am working at the moment but thats only 20hrs as I am on a student visa at the moment.
Will appreciate any Advice.
Thanks

You have been in the UK for 2 years yet you obtained a Bachelors and Masters from here...how so??

Anyway, to answer your question....no, you cannot at all bring your parents or siblings as dependents, as there is nothing in the immigration rules that allow people on student or HSMP/WP visas to do so. Only your spouse and your children under 18 can join you.

The only chance of any of them joining you is once you obtain permanent residency (ILR), and who knows how long that'll take!! Also, your siblings usually won't qualify under UK immigration law, as there isn't anything in the provision for sibling sponsorship.

So, unfortunately, you cannot help them right now.

Its a good idea to apply for the HSMP,but the reasoning behind it is not sincere.
You have been in the UK for 2 years and had your BSc and Msc here ????
If your HSMP is successful and decide to bring your family into the UK in a ratio of 1:4,the ECO will reject your application point blank.
I advise you to work here and send your earnings down to take care of your parents.

Unfortunately (or not), that isn't even possible, as there is no provision whatsoever for people on visas, such as HSMP, to bring in their parents or siblings. So even if she were to apply, which she cannot anyway, it would be refused immediately because there is no provision.

My advice would be to concentrate on getting the HSMP first. It is highly unlikely that you would be able to sponsor your family though. Perhaps if it were just your dad, and he had no one else, than you could do so exceptionally outside of the rules, but not when he has his wife to help him.
