FLR (o) Appeal Refused

Post by ssfamily » Wed Feb 17, 2016 7:46 pm

Hi All,

I am a British Citizen and so is my son. I brought my wife and 3 daughters to the UK in Nov 2012 (old rules) on spouse visa for my wife and dependent visas for my daughters. At that time time all 3 daughters were under 18years.

I applied for their indefinite FLR (M) for my wife and FLR (O) for my 3 daughters in Nov 2014 as their visa was about to run out. At this point all 3 daughters were over 18years old. This application was refused due to insufficient earnings (£30 less a week). Since then I started working full time and went to court to appeal the decision. I am now earning enough to qualify under the rules. However in Feb 2016 the appeal has been refused with no right of appeal.

I am very worried as my we don't have any family in my country Afghanistan and I don't want my family to leave me. I have had triple heart by-pass operation in Oct 2013 and unfortunately my wife has a severe heart attack in Nov 2015. She now has a stent in her heart and is on medication for life.

Despite all these facts and me now meeting the financial requirement the appeal has still been refused!

What options do I have now? I am british citizen and so is my son. We all want to live in the UK as a family.

Please advise.

There is no indication from the post that the son who is British is over 18.

My son is over 18 and a British citizen studying at uni. I am a British citizen age 63. My income was low when I applied for my daughters and wife indefinite leave. Just before applying for their ILR I was on ESA and couldn't work due to open heart surgery. When the HO was deciding the case I was told by the HMRC that I may return to work now as I am fit. I started looking for job but to no avail. And now the circumstances are as such that I don't know what to do. as I am working full time and meeting all the requirement as well.
