I hope someone could help me with advice, I will really appreciate.
I'm currently on Tier 1 (entrepreneur) Dependent visa (unmarried partner), I live in the UK for 2 years now. I have a daughter of 3 years old and she is on Tier 1 (entrepreneur) Dependent visa too.
I know that my partner wants to cancel my and my daughter's visa. If he does so, am I allowed to stay in the UK until my visa is finished? Can I claim any financial help for myself and my daughter from him? Should we leave the country as soon as he cancels our visas?
I'm really in panic now, can anyone advice please?
Thank you,
Vika
The right to cancel/curtail someone's visa remains exclusively with the HO, so your partner cannot demand your visa to be curtailed when he desires. However given that your right to remain here was granted as a Tier 1 dependent under the assumption that you are in a partnership, HO might choose to curtail your visa if there is sufficient evidence that such partnership no longer exists. Even if they do not curtail your visa, you will not be able to switch or remain in the uk after your visa runs out unless you argue that leaving the uk will put you and your daughter at serious risk.
If you have experienced abuse or your partner refuses to provide financial support for your daughter, you need to contact relevant authorities as soon as you can and get proper legal advice.
