I was in Tier 2 work visa for 3 years and applied for the extension on last 16th of January 2016. My visa was expired on 28th of January 2016. And we received the letter from the Home office mentioning that my visa application has been refused. The letter of the decision was 11th of February 2016. I have received the letter on 19/02/2016 and the reason for the refusal is that I am not getting appropriate salary for my job. My occupation code is 2213 and minimum acceptable rate of pay for my employment is £ 30,764. My current salary is £ 33000 and my employer mention in the CoS as I work 45 hours per week. Because of that they refuse my application saying that ‘ Your certificate of Sponsorship state that your salary would be £33,000 per annum for a 45 hour working week and as such the minimum acceptable rate of pay for a 37.5 hour working week for your prospective employment would be £27,500 per annum and that salary is not at or above the minimum rate as specified in the Codes of Practice under the experienced worker level’.
They have asked me to apply for administrative review within 14 calendar days.
My employer agreed to issue me a new CoS with a new salary of £37,000 .
Am I allowed to make a new application with that new CoS?
If I can within How many days I have to apply?
Could you please kind enough to give some advise regarding matter.
