Help Please: HO Is not considering FLR (HSMP) Application

Hi all, I need a help,

I have sent My FLR(HSMP) application visa stamping in November first week and my student visa expires last week. H.O call and said your Masters degree is not from UK in which you were on student visa so before we(H.O) reject your application we offer you to withdraw your application and apply for EC.
(Note: I didn't claim points on this Masters degree at all, claimed points only on my bechlors degree with the NARIC letter, with IELTS 6.5 and past earnings and age).

As do I know anyone can apply for FLR(HSMP) if your college/institution is registered in UK and maintained satisfactory attendence records, regardless of degree awarding if you are not claming points on that...

what you say guys? What should I do? because I have already started My MBA from the university in this October. should I apply Student Extension first ? and then in January/Feb term break go back to my country and apply EC.? ...

If you have student visa in the UK, you cannot apply for FLR under HSMP until you have a degree from British uni. YOU MUST HAVE COMPLETED YOUR DEGREE BEFOREY YOU APPLY FOR FRL UNDER HSMP. Home office has rightly asked you to withdraw your application and apply for EC.
Even you are not claiming on degrees done outside UK.

Only the following category of Visaholders can switch in-country from their existing leave to HSMP LtR:

• a work permit holder;
• a student who has successfully obtained a degree qualification on a recognised degree course at either a United Kingdom publicly funded further or higher education institution or a bona fide United Kingdom private education institution which maintains satisfactory records of enrolment and attendance;
• a postgraduate doctor or dentist;
• a working holidaymaker;
• a participant on the Science and Engineering Graduate Scheme or the International Graduate Scheme;
• an innovator;
• a participant on the Fresh Talent: Working in Scotland scheme.

Since you have not satisfied point 2 above, you cannot switch in-country. You need to return to your home country and apply for EC.


Luyer, if you master's satisfies the above requirement (Point 2 above), you are okay to switch.
