Can tier2-ICT visa Employ get back to UK with Europe Visa

Hello ,
- I was working for "XX" company in INDIA from last 2 years.
- I was sent to UK on Recent(OCT-2015) Tier2-ICT Visa, Sponsored by "XX" Company to work for there "YY" client in UK .
- Now the "YY" clients wants to hire me as there permanent employee in UK branch...! either by buying me from my "XX" company or by asking me to quit the "XX" company and join as a new employee to "YY" company...! :)

- Can you please help me to understand what are the options I have to be able to work for "YY" company as there permanent employee in UK.
- Can I switch my Sponsor to "YY" company ...? <I believe a recent tier2-ict cannot switch Sponsor..! >
- Can I quit the "XX" company, and get a new Offer Letter and COS from "YY" company and apply for new Tier-2 Visa from india ..?
- Can I get a European visa using Offer Letter and COS from "YY" company and come and work in UK ..?

or what other options I have to be able to come and work for "YY" company as it's employer...?

and what is the difference between "Tier-2 ICT" and "Tier-2 ICT Established Staff" Visa ...?

12 months cooling off period required.

Tier 2 Established Staff is a now defunct visa category.

Can I quit the "XX" company, and get a new Offer Letter and COS from "YY" company and apply for new Tier-2 Visa from india ..?

That means you must not be in the UK for 12 months before you apply for a new Tier 2 with a new company.

For cooling off period, The only exception to this rule is if the individual has been offered a new role and will be paid a salary of at least £152,100.

So, if my new YY employer offers me new job with above salary can I switch my tier2ict to tier2 General right away without any constraints...

Is that a realistic salary for what you do?

Nice salary if you can get it.
Please be aware that the salary payments get checked via HMRC to ensure that it is actually being paid. Being offered the salary to get the Tier 2 exemption on the cooling off period is heavily monitored to ensure there is no abuse.
If that salary level is made up of commissions and bonuses it will not be accepted.

I was just thinking of below tweak in my offer Letter..!

- What if my YY company mention in my offer letter that I will be paid hourly basis i.e 53.92/hr, that will sum-up to ~£155,300/year(8hr/day). And myself and Client have a understanding of actual agreed salary ....? :) and if tomorrow HMRC questions the salary I am being paid they can say.. "That many hours only he has worked...! ".. :) :) :)

What do you have to say..?

I would say you might as well book your flight home now and forget any thoughts of returning to UK.

UK doesn't need any more liars and cheats.

You are going to face some serious cultural challenges (& future immigration issues) should you ever make it back into UK to work in a professional sector.

HO are well versed in these little ploys and gimmicks.

That is an incorrect hourly rate calculation, if considering a 52 week year and 40 hours per week!
