Out of Country Tier 2 Application

Hi All ,

I'm on Tier 1 Entrepreneur visa which is due to expire in Jan 2017. My wife is on Tier 1 Entrepreneur dependent

She is working as software developer in a IT firm based in UK. Now she wants to switch to Tier 2 General as she is on Tier 1 dependent she can't make In country application she needs to apply from Home country. This is what most us know.

My query is How Residence Labour market test needs to be done by her employer as she is current employee of that company if they want to sponsor her ?
Also is there any High Priority service (Fastest Service ) to Tier 2 General if she wants to apply from India ?
Are there any chances for rejection ?
We are planning to go India for 1month and apply the visa from India for Tier 2 as we got current leave till Jan 2017. What is the maximum time to get Tier 2 general.
