EMERGENCY Situation:-
Initially after obtaining an entry visa we were misinformed by our immigration advisor that they will not check financial situation when applying for an extension. As a result I being an overseas qualified Dentist decided to take a step away from full time employment and focus on giving my UK registration exams.
Over the last 2 years my wife and I have been working as Bank/Temp staff for the same employer whilst I am studying to register as a Dentist in the UK, she is enrolled at a London University doing her Masters in Education. If we had known that our financial situation would be checked we would have easily been able to commit to full time jobs.
Her visa expires on 4th April 2016 and I started to read the requirements for extension in December. Having received a shock I straight away took up an existing offer with my current employer (£30,000 Annual) and my wife since mid February started a full time permanent position with her current employer (£16,400 Annual). Roughly this would give us a combined annual income of £46,400.. if only it was so simple!
Even though our employer has been the same over the past two years I do not think this will be applicable for CATEGORY A as we have moved from a temping role to a full time permanent position. I may be wrong could someone please clarify this for me..
Under CATEGORY B Part 1 we would satisfy the requirement... as for Part 2- to show that we meet the £18600 over the last 12 months.. This part also raises a question.
Below is our financial situation:
Applicant Spouse
31-Mar-16 1386.67 2500
Feb-16 506.95 2500
Jan-16 228.64 2500
Dec-15 775.52 250
Nov-15 690.32 420
Oct-15 605.2 240
Sep-15 1174.48 912.36
Aug-15 1573.44 302.4
Jul-15 0 302.4
Jun-15 735.2
May-15 878.64 453.6
Apr-15 856.64 151.2
Mar-15 80.73 0
We have booked a Premium Service appointment for her Visa extension which is on the 18th of March 2016.
Financial Requirements Category A:
Combined 6 month total of husband and wife (as appointment is on 18.03.16 I will not include the income for march) = £10,803.47
Divide by 6 then multiply by 12 = 21606.94
According to this calculation we would meet the requirement. BUT I have a doubt that we will not be able to combine monthly wage from the temping positions with the monthly salary in the current permanent positions regardless of being in the same company for 2 years. They have not been clear or documented this scenario in the guidance. Yes we have been with the same employer for 6 months or more but it does not state the view for combining salaried and non salaried employment if with the same employer.
Financial Requirements Category B:
Part 1 - our current combined annual salaries is £46,400. so we meet the requirement.
Part 2 - does the combined income over the last 12 months = £18,600
As my wife's visa expires on 04.04.16 we have booked a premium service appointment on the 18.03.16
combined income over the last 12 months (Mar15-Feb16) = £16,137.72 which does not meet the requirement.
HOWEVER is it not self explanatory that if I apply 13 days later i.e. 01.04.16 our last 12 months would include the pay for March2016 and would hence be (Apr15-Mar16) = £19,943.66 which does meet the requirement.
Would we be declined on the fact that we applied 13 days too early?
Could someone please shine light on the matter.
Would we be able to apply under Category A?
if applying under category B on the 18th of march would we be declined?
Should we postpone the premium appointment till the 1st of April (even though her visa expires on the 4th..3 days later) and include our pay for march which should have come by then.
Thank you in advance
