Hi,
Does anyone know how child maintainence payments from ex spouse are calculated? I tried phoning the ukba agency helpline and they were useless.

I know from the regulations I need to supply 12 months of bank statements however in july I was paid cash in hand and august was late (2nd sept - 2 payments that month). I get minimum of 500gbp per month (evidence - financial agreement which is order of court and solicitors letter. Gross payments bring me over the limit however is it calculated like non salary employment (average) or salaried employment which means july would render it all void?

In addition i have 13900k gdp salary employment (just got pay increase, only 13000 in qualifying period).

I also get 575 rental income from former matrimonial house (2 years rented with money paid directly to me for 1.5years, all contracts with me, but joint names on mortgage (was originally just me, but agreed to add ex to protect his financial interests in property after divorce should anything happen to me). Evidence for this is 1 years bank statements, rental agreement and contract with letting agent, summary of landlord accounts and mortgage statement with ex and I named on account.

In short do i qualify to bring my non eu husband to the UK (i have 2 young kids travel is difficult. He has a uk degree so no probs with english requirement).

Have you declared the rental income for tax purposes? UKVI hot on tax at the moment.

Yes. All up to date. Although tax is only on net profit not gross amount. Do i need to show this?
Obviously I need them to use the gross amount to qualify :/

I would, there's been lots of horror tales on tax lately, just read the forums. If you claim it, they need to see it via HMRC records, think also you might have to fill a self assessment out too.

These horror stories seem to more related to ILR but best to keep squeaky clean when Hector is involved.

Net amount, i.e. the income less any expenses, but not tax, i.e. net profit before tax.

Might need to go the 12 months route with an element of SE in the mix which I think you are doing.

I believe you can count maintenance payments too.

Ah that reduces it all significantly if i take out mortgage payments too. No mention on this on website (i thought even agents fees weren't taken out. Has this changed then recently?
Also do you (or anyone) know if maintenence payments are used as an average over the 12 months or if one month not paid into my bank mean it cant be counted

I met with an immigration solicitor (paid 120 for it too) a few months ago. Led me to believe I was ok. But closer inspection and other issues with her advice has made me question that I actually do. JUST as i was going to apply :(

Has to be net if you think about it - you could be selling on 'widgets' - the standard thing used in cost accounting exams, say 4000 at 100 quid each, at lot of income but if you are paying 3950 each for them, then the real income isn't so good....

If gross was accepted by UKVI then £400,000 would smash it, but it's not a true reflection - knock off £395,000 costs and that leaves £5,000 which does reflect the true financial position.

Wanderer that's incorrect, the mortgage amount is not deducted from the rental amount.
