Hi,

I have a similar issue. I was contracting when I was on Tier1 General and was running my pay through an umbrella company. I ran the pay for 30K pa and based on the payslips provided, I got my Tier1 extension. Once after the extension I took some break and been to home and came back and joined a new company and used P46 at that time because I couldn't able get in touch with umbrella company man so I didn't have a P45. Later I moved on and got my ILR as well. Now I am eligible for applying Naturalisation wanted to go for it. But as my friend suggested I got my NI paid details from HMRC and during that year the NI paid is zero. I am not sure whether he (umbrella company) paid the tax or not.
I got few doubts regarding this
1. What if he hasn't paid the tax during that year will that come to consideration as the new application form is specifically asking for all the employment details
2. What if he has submitted to the HMRC as my pay is non taxable (i.e. less than 10K) for that year, does that come as I deception as I don't meet the criteria for the earnings. Will that cause to cease my ILR?

All of your suggestions, will be highly appreciated.

The key question to ask in these cases is whether you would have at any point along the immigration journey gotten a required visa/extension without the discrepancy that triggered the refusal. If the answer is 'no', then there is a good and justifiable reason to think that the HO might come after your ILR.

Would you have qualified for the extension without this action? The answer to that heavily influences the answer to the question of whether you may or may not retain your ILR.
